What Families and Nursing Homes Should Know

A recent policy update from the New York State Department of Health expands access to healthcare for undocumented adults aged 65 and older. Previously, this group was only eligible for Emergency Medicaid, which covered limited, urgent medical services. As of January 1, 2024, eligible people may now receive broader coverage through mainstream Medicaid managed care plans, including access to nursing home care. However, coverage for long-term nursing home care is not immediate but begins only after plan enrollment and approval, which may result in delays.

    What Has Changed

    Undocumented adults aged 65+ in New York may now qualify for full Medicaid coverage, rather than being limited to emergency services. This expansion allows access to a wider range of healthcare services through managed care plans.

    When Nursing Home Coverage Starts

    Coverage for long-term nursing home care starts only after two steps are completed:

    • Enrollment in a Medicaid managed care plan
    • Approval of the nursing home placement by the plan

    This means there may be a delay between eligibility determination and when coverage begins.

    Those eligible may receive coverage for long-term nursing home care if they meet standard Medicaid financial eligibility requirements, including income and resource limits. These determinations are made by the Department of Health using existing Medicaid rules.

    Important Eligibility Considerations

    People without a Social Security Number, income, or considerable financial resources can still apply. Applications should be completed as fully as possible, but missing information, such as an SSN, does not automatically disqualify an applicant.

    Application and Documentation Process

    Facilities assisting with applications must submit required forms and supporting documentation to the appropriate agencies. These documents are used by the Department of Health to determine eligibility for coverage.
